The regulations passed to make this happen includes provisions that require the Secretary of State for Health and Social Care to publish guidance for NHSE about its data functions. \u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EIn May 2023, the Department of Health and Social Care published guidance about NHSE\u2019s protection of patient data. The guidance covers data that falls within the definition of confidential information, including identifiable data as well as de-identified data where the individual could be re-identified through combining the de-identified data with other data or information.\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EThe guidance sets out the expectation that NHSE will continue NHS Digital\u2019s role as a safe haven for data and maintain at least the same degree of protection, levels of safeguards and transparency. Along with the transfer of data functions, the regulations ensure that the same legal framework applies following the transfer, and that the same restrictions on the use and dissemination of data apply. \u0026nbsp;\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EThe guidance sets out governance arrangements for NHSE\u2019s new data functions, organisational responsibilities, and procedures for internal access to data to enable other parts of NHSE to access data to provide and improve NHS services whilst ensuring that processes are as rigorous as for external requests. It also includes guidance for the set-up of a data advisory group to replace NHS Digital\u2019s \u003Ca href=\u0022https:\/\/digital.nhs.uk\/about-nhs-digital\/corporate-information-and-documents\/independent-group-advising-on-the-release-of-data\u0022\u003EIndependent Group Advising on the Release of Data\u003C\/a\u003E (IGARD), to provide expert advice on the use of data, transparency, and safeguarding.\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EThe guidance will be kept under review annually and the Secretary of State must consult with NHS England and other relevant persons including the \u003Ca href=\u0022https:\/\/understandingpatientdata.org.uk\/who-decides-access#national-data-guardian-for-health-and-care\u0022\u003ENational Data Guardian\u003C\/a\u003E.
